Terms of Service

Effective: October 12, 2026

These Terms of Service ("Terms") govern your use of the mi mi Friend mobile application ("App") operated by DRIMSSY SRL ("we," "us," or "our"), registered in Romania, EU.

By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility & Age Requirements

• All ages may use the App, subject to age-appropriate protections.
• The App offers the same safe, button-based experience for everyone: there is no free-form chat, no microphone, and no voice input for any user, of any age.
• Users under 16 require verifiable parental consent before the account is fully activated.
• Users 16 and older may consent on their own behalf.

2. Account & Activation

• An activation code (from a physical mi mi product or issued digitally) is entered to activate your companion, and your email is verified.
• You are responsible for keeping your account credentials secure.
• One account per activation code.
• We may suspend or terminate accounts that violate these Terms.

3. Permitted Use

You may use the App for personal, non-commercial purposes. You agree to:

• Provide accurate information during registration.
• Use the App in compliance with all applicable laws.
• Not attempt to circumvent age restrictions or safety features.

4. Prohibited Conduct

You may not:

• Use the App for harmful, illegal, or abusive purposes.
• Bypass content filters, age gates, or safety mechanisms.
• Cheat in, exploit, or manipulate games, leaderboards, multiplayer sessions, or the in-game economy.
• Use automated tools, bots, or scripts to interact with the App.
• Attempt to access another user's data or account.
• Share your account with others or create accounts on behalf of others without authorization.
• Photograph people with the in-game camera, or use it to capture anything unlawful, harmful, or offensive. The photo-to-3D workshop is for objects.

5. Companion Content

• mi mi responds using a curated library of pre-written, pre-recorded content created and reviewed by our team. It is not generated by artificial intelligence.
• Companion and educational content is provided for entertainment and learning and does not constitute professional advice (medical, legal, financial, or otherwise).
• We review content for age-appropriateness, but if you find content you believe is inappropriate, please report it via the in-app Support feature.

6. Content & Interactions

• All companion and lesson content is pre-authored and curated; mi mi does not generate its replies or lessons in real time.
• Interaction takes place through buttons and ready-made options. There is no text chat, voice chat, or free-form messaging: players communicate only through preset stickers and gestures.
• If parents have allowed online play, the child can play together with other children: share their Doodle world, visit worlds that other children have shared with everyone after review by our team, and draw together if the world's owner has allowed it. What other players can see is described in the Privacy Policy.
• Support messages you send are used only to help you with your request.

7. Photo-to-3D Toy Workshop

• Where the feature is enabled for your account, you can photograph an object with the in-game camera and the App will generate a 3D toy from it. This is the only part of mi mi where content is generated for you rather than pre-authored.
• The photograph is used only to generate that 3D toy and is never stored. The generated model and its thumbnail are stored in your collection. See the Privacy Policy for the full detail.
• You may photograph only objects you are entitled to photograph. Do not photograph people, and do not capture anything unlawful, harmful, or offensive.
• A generated toy is visible only to the person who made it and is never shown to other players. We may remove a generated toy that breaches these Terms.
• Generation is limited per day and per hour, and the feature may be switched off, changed, or limited at any time — it is offered as-is and without guarantee of availability.

8. mi mi Arena & Virtual Items

• mi mi Arena offers single-player and multiplayer games, public leaderboards, an in-game cosmetics shop, a daily prize wheel, and shareable friend codes.
• In multiplayer, your companion's preset name, position, and cosmetics are visible to other players in the same session, and leaderboards display your preset companion name and scores publicly.
• Online with friends works only with a code the child gets from a friend. To turn online play off, parents can withdraw their consent or write to std@drimssy.com; more detail is in the Privacy Policy.
• In-game currency (coins, gems) and items have no real-world monetary value, are not your property, cannot be purchased with or exchanged for real money, and may be adjusted or reset as needed to operate the service.
• You agree to play fairly and not to cheat, exploit, or disrupt multiplayer or the in-game economy.

9. Subscriptions & Payments

• The App may offer optional premium subscriptions.
• Where a subscription is offered, payments are processed by the Apple App Store or Google Play Store.
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• Refunds are handled per the respective store's refund policy.
• We do not collect or store payment card information.

10. Intellectual Property

• The App, its design, characters, and content are owned by DRIMSSY SRL.
• You retain ownership of content you create (such as support messages and photos you take in the App).
• By using the App, you grant us a limited license to process your content for service delivery. For a photo taken in the photo-to-3D workshop this means one thing only: generating the 3D toy and storing the resulting model in your collection.

11. Privacy

Your use of the App is also governed by our Privacy Policy, available in the App. Please review it carefully. Key points:

• We process data in accordance with GDPR, COPPA, and applicable EU regulations.
• You have rights to access, export, rectify, and delete your data, including in-app data export and account deletion.
• Children's data receives enhanced protection.

12. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
• Nothing in these Terms limits liability for fraud, gross negligence, or death/personal injury caused by our negligence.

13. Termination

• You may delete your account at any time via the App (Profile → User Data → Delete Account).
• We may suspend or terminate access for violation of these Terms.
• Upon termination, your data will be deleted in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms. Significant changes will be communicated via the App. Continued use after changes constitutes acceptance.

15. Governing Law & Disputes

These Terms are governed by the laws of Romania and the European Union. Disputes shall be resolved in the courts of Brașov, Romania, without prejudice to your right to bring proceedings in your country of residence under EU consumer protection law.
